From Indiana Senate Republicans:
This November, Hoosiers will be asked to vote on an amendment to our state constitution that would allow judges to deny bail to dangerous criminal suspects.
Indiana’s constitution currently requires all criminal suspects to be offered bail unless they are charged with murder or treason. Unfortunately, Hoosiers are seeing an increase in instances where dangerous suspects are released on bail only to commit more violent crimes.
To address this serious issue, the General Assembly passed legislation in 2023 and in 2026 that would give Indiana judges the power to hold a suspect in jail when releasing them poses a substantial risk to the public. Now, that legislation will appear on the ballot as Public Question 1 during this year’s midterm elections.
Protections for the accused were also put in place with Senate Enrolled Act 2, which guarantees suspects’ rights like the right to a speedy bail hearing and the right to an attorney.
Hoosiers should feel safe in their communities, and as your state senator, I will continue to make public safety one of my top priorities.
